What is a Deed Poll?
A deed poll is a legal document that allows an individual to officially change their name and requires all persons and organisations to recognise the change. It is a declaration that you will use your new name at all times.
Deed polls have been a legal method to change names for over 150 years. Using a deed poll, you can officially change your name. You have the flexibility to change all or part of your name, add or remove names, or alter the spelling. You can change your name as many times as you want for any reason, as long as it is not for fraudulent purposes.
If you are married and wish to change your name, you will need to obtain written consent from your spouse. If you are divorced and wish to revert to your maiden name, you may not necessarily need to change your name legally. You might need to submit your divorce papers to relevant authorities, such as your bank, the passport office, or your doctors.
What are the Different Ways to Change My Name?
You can change all or part of your name, you can change as many times as you want for whatever reason, provided it’s not fraudulent. There are two ways to apply, “Unenrolled” and “enrolled” deed poll.
If you are over 16, you can change your name without it being listed on the public record by using an unenrolled deed poll.
Enrolled deed polls are registered in the Enrolment Books of the Supreme Court of Judicature, which is situated in The Royal Courts of Justice located in The Strand, London. This process creates a permanent public record of the name change. Relevant details are also published in the London Gazette.
Our Change of Name Deed Solicitors can draft your change of name deed and handle all necessary paperwork. Contact us today if you require our deed poll service.
What is the Deed Poll Process?
Changing one’s name legally in the UK can be a significant step in a person’s life, whether it’s for personal or professional reasons. The standard procedure for changing your name by deed poll is set out by the following steps.
Step 1 – Gathering Documents and Applying for Deed Poll
The initial step involves collecting all the necessary information from you and preparing the documents. After this, we can proceed with the application for the deed poll. Our Change of Name Deed Solicitors will ensure that the deed poll document complies with all legal requirements. The deed poll document is a declaration of your intention to abandon your old name and use your new name at all times.
Step 2 – Sign Your Deed Poll
Once your deed poll document has been created, you must sign it in the presence of a witness who is not a member of your family and is over 18 years of age. Our solicitors can act as witnesses and can also provide extra copies of the deed poll for you to share with relevant parties.
Step 3: Notify Relevant Organisations
After signing your deed poll, it is important that you let all government agencies and other organisations know about your new name. This process involves updating your passport, driving licence, bank accounts, and notifying HM Revenue and Customs (HMRC) of your new name. It is essential to ensure your new name is registered everywhere to avoid any legal discrepancies.
Once you have signed the deed poll and informed all relevant parties, you can begin using your new name in all areas of your life. All UK government agencies, banks, and companies will acknowledge this legal name change, and can also be recognized internationally.
How Long Does the Deed Poll Process Take?
The Deed Poll process can usually take anywhere from a few days to a few weeks depending on the documents being received, working days and postal services.
We would usually expect to have taken your instructions within 2 working days of you having purchased the product and would expect to have produced your documents within 7 days. Special dispatch may be available where necessary at an extra charge.
Once the Court receives the documents, they will check to make sure they are correct and will return the deed poll to you in an envelope sealed with its number. The Court will forward the draft notice to the London Gazette who will publish it at their earliest convenience.
