This is a specialist legal area that requires the application of experience. Jonathan Mounteney has been involved in many business recovery projects during:
- Almost 10 years as an in house solicitor for Sony Group and for Co-operative Financial Services
- Over 10 years in private practice advising blue-chip clients.
We are able to assist with various issues including:
The conduct of litigation in the Civil Courts or Employment Tribunals. We also manage business matters in Magistrates Courts and work in association with Family Lawyers for matters our commercial clients occasionally encounter. We make referrals for Criminal matters.
Employment Compromise Agreements.
Employment Compromise Agreements are often used where the employer and employee do not want to follow what could be a long, drawn-out process, such as a performance review or a full redundancy process, before terminating an employment. An agreement to waive employment rights can only be binding if made on the advice of an independent solicitor or certified adviser.
There are a range of scenarios in which Settlement Agreements are used, often it is where parties do not want to follow what could be a long, drawn out process, or to avoid certain processes or possible claims. An agreement to waive legal rights can only be binding if properly implemented. Complex issues will arise, such as staying-litigation, costs, payment terms etc.
We are especially experienced with complex commercial disputes of a difficult nature e.g. where existing advisors may have prejudiced resolution.
